The deal

Gasper is a horror film logger made by Avigage. By creating an account or using the app you agree to these terms. If you do not agree, do not use Gasper.

Your account

Keep your login credentials safe; you are responsible for activity on your account.

You must be old enough to use Gasper under the App Store age rating and the laws where you live. Horror content can be intense; that is rather the point, but discretion is yours.

Acceptable use

Gasper has zero tolerance for objectionable content and abusive users. Do not post anything hateful, harassing, sexually explicit, threatening, or unlawful, and do not harass, threaten, or impersonate other members.

Be a good ghoul in the rest of it too: do not spam the feed, scrape the service, or try to break, probe, or overload it.

You can report any post, review, comment, list, or profile, and block any account. Blocking someone hides them from you straight away, and they are not told. We review every report within 24 hours, remove content that breaks these rules, and remove the accounts that posted it.

Your content

Your rankings, lists, comments, and profile are yours. By posting them you give Gasper a license to store and display them within the app so the social features work (your followers seeing your rankings and lists, community scores, and so on).

Deleting your account ends that license and removes your content from our servers.

Film data

Film metadata comes from TMDb. Gasper uses the TMDb API but is not endorsed or certified by TMDb. Posters, stills, and credits belong to their respective owners.

Copyright complaints

Gasper does not host films. Posters, stills and credits come from TMDb under licence. What members put here is their own: profile photos, written reviews, list names and descriptions, and scream recordings.

If you own the copyright in something a member has posted and you believe it is here without permission, send a notice to our designated agent:

To be valid under 17 U.S.C. § 512(c)(3), a notice has to include all six of the following: your physical or electronic signature; identification of the work you say was infringed; identification of the material you want removed and enough detail for us to find it, such as the member's handle and what they posted; your address, phone number and email; a statement that you believe in good faith the use is not authorised by the owner, its agent or the law; and a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorised to act for them.

A notice missing any of those may not be actionable, and § 512(f) makes knowingly misrepresenting that something is infringing something you can be sued over. If you are unsure whether the use is a fair one, ask a lawyer before sending.

When a complete notice arrives we remove or disable the material promptly and tell the member who posted it, passing on your notice.

If your content was removed and you believe that was a mistake or a misidentification, you can send a counter-notice to the same agent. It needs your signature, identification of what was removed and where it was, a statement under penalty of perjury that you believe in good faith it was removed by mistake, and your name, address and telephone number along with your consent to the jurisdiction of the federal court for your district (or, if you are outside the United States, for any district where we may be found) and to accept service from the person who complained. We forward it to them, and unless they file a court action we may restore the material in ten to fourteen business days.

Accounts that repeatedly infringe are terminated. That is a policy we apply in appropriate circumstances, as § 512(i) requires.

Disclaimers

Gasper is provided as is, without warranties of any kind. We work hard to keep it up and your data safe, but we cannot promise uninterrupted service, and we are not liable for indirect or consequential damages to the extent the law allows.

Scare Scores are community opinion, not a safety rating. If a film ruins your sleep, that is between you and the film.

Changes and termination

We may update these terms as Gasper evolves; material changes will be announced in the app. You can stop using Gasper and delete your account at any time.
